
ASPPH and APHA, joined by dozens of other organizations, deans, program directors, and other public health scholars, filed a Friend of the Court brief on Tuesday evening with the US Court of Appeals for the Sixth Circuit in support of the emergency COVID-19 standard issued by the Occupational Safety and Health Administration (OSHA). The standard was issued by OSHA on November 4 and enjoined by the 5th Circuit Court of Appeals on November 12. OSHA’s standard requires covered employers to ensure that employees are either vaccinated against COVID-19 or wear masks and undergo regular testing. ASPPH and APHA led the brief, which was joined by more than 30 public health deans and program directors, along with other faculty leaders. The Associations were assisted by the Gupta Wessler law firm and the leadership and faculty of the George Washington University Milken Institute School of Public Health. Various challenges to the OSHA standard have been consolidated – by lottery – to the Sixth Circuit, which sits in Cincinnati.
